Terms of Service

1. The service

Forgely is a platform for Discord server owners to create Discord bots from pre-built templates, customise them with our AI assistant (“Forgely AI”), deploy them to managed cloud hosting, and optionally charge their own users through integrated payments. Bots generated and hosted through Forgely run on third-party infrastructure we provision on your behalf.

Accounts are created and authenticated through our identity provider (Clerk), including email and Discord sign-in. You are responsible for keeping your credentials secure and for all activity that happens under your account. Notify us immediately of any unauthorised use.

Premium plans sold by bots are different. When you subscribe to a premium plan offered by a bot built on Forgely, you have a 7-day refund window from the time of purchase. Within that window you may contact us to request a refund. After 7 days, any refund is at the discretion of the bot owner who sold the plan, as they are the merchant of record for that sale (see section 10).

Initiating a chargeback or payment dispute instead of contacting us first may result in immediate, permanent termination of your account and bots. Please reach out so we can resolve the issue directly.

You are solely responsible for the bots you create, the configuration and content you supply, and how your bot behaves in any Discord server. You represent that your bot and its content:

8. Bot owner responsibilities & enforcement

If you build or operate a bot on Forgely, you are responsible for ensuring it and everything it does stays within Discord’s Terms of Service, Community Guidelines, Developer Policy, and the terms of any other platform or service it touches.

If a bot breaches Discord’s rules, another platform’s terms, or applicable law, we may, with or without notice:

9. Platform & AI integrity

Forgely AI, our prompts, our hosting environment, and our payments integration are core parts of the service and must not be tampered with. You agree not to attempt to:

We monitor for this kind of abuse. If we detect it, we may immediately take down your bot(s), delete associated data, cancel your subscribers’ premium access, suspend or terminate your account, and pursue any other remedy available to us. These protections exist to keep the platform, its creators, and their communities safe and trustworthy.

10. Monetisation and payouts

If you charge your bot’s users, payments are handled through Stripe Connect. You are the merchant of record for your own sales and are responsible for your offering, customer support, refunds outside the 7-day window described in section 5, and applicable taxes. Forgely facilitates the connection and deducts a platform fee disclosed in your plan. You must complete Stripe’s onboarding and comply with the Stripe Connected Account Agreement.

11. AI-generated code

Forgely AI helps generate and modify bot code. AI output is provided “as is”, may contain errors, and is not guaranteed to be correct, secure, or fit for any purpose. You are responsible for reviewing, testing, and operating any code before relying on it. You own the bot configuration and code generated for your account, subject to the licences below.

12. Discord tokens and secrets

To run your bot we need your Discord bot token and related secrets. These are transmitted over HTTPS directly to the hosting environment’s secure variable storage. We do not store your Discord bot token in our own database and we do not log it. You remain responsible for keeping your Discord application and its secrets secure on your side.

13. Intellectual property

Forgely, including the platform, templates, branding, and base bot framework, is owned by us and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable licence to use the platform while your account is in good standing. You grant us the licence necessary to host, store, process, and run your bot and content to provide the service.

14. Copyright & DMCA

We respect intellectual-property rights and expect our users to do the same. If you believe a bot hosted on Forgely copies or infringes a bot, codebase, or other work you own the rights to, you can submit a takedown request under our DMCA & Copyright Policy. Repeat infringers will have their accounts terminated.

15. Third-party services

Forgely relies on third parties including Discord, Stripe, our cloud hosting provider, and our identity and AI infrastructure providers. Your use of those services through Forgely is also subject to their terms, and we are not responsible for their acts, outages, or policy changes.

16. Suspension and termination

You may stop using Forgely and delete your bots at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or create risk or legal exposure for us or others. On termination, your bots and their hosting may be stopped and associated data deleted. Sections that by their nature should survive (ownership, disclaimers, liability, indemnity) will survive.

17. Disclaimers

Forgely is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, uptime, or that the service or any bot will be error-free or uninterrupted. We do not guarantee any level of availability.

18. Limitation of liability

To the maximum extent permitted by law, Forgely will not be liable for indirect, incidental, special, consequential, or lost-profit damages, or for lost data or revenue. Our total liability for any claim relating to the service is limited to the amount you paid us in the three months before the event giving rise to the claim.

19. Indemnification

You agree to indemnify and hold Forgely harmless from claims, damages, and costs arising out of your bots, your content, your use of the service, or your breach of these Terms or of any third-party terms (including Discord and Stripe).

20. Dispute resolution

Before starting any formal proceeding, you agree to first contact us and try to resolve the dispute informally. Where permitted by law, disputes that cannot be resolved informally will be settled by binding individual arbitration rather than in court, and you and Forgely waive the right to participate in a class or representative action. Nothing in this section prevents either party from seeking injunctive relief for misuse of intellectual property or the protections in section 9.

21. Changes to the service and these Terms

We may update the service and these Terms from time to time. Material changes will be communicated through the app or by email. Continued use after changes take effect means you accept the updated Terms.

22. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, unless mandatory local law provides otherwise. (Confirm or change this to match your registered jurisdiction.)

23. Miscellaneous

These Terms, together with our Privacy Policy, Cookies Policy, and DMCA Policy, are the entire agreement between you and Forgely. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
